The Kimmer - Deposed! Meet Heidi Diaz!

The image above is a screen shot from the deposition given by Heidi Diaz on November 12th, 2007. Wanted to share this here just to keep the record of the Fall of Kimkins complete!

Also, as per the writ of attachment filed in the courts, Heidi Diaz's assets are now frozen.Keep up the good work! And kudos to Christin for her local news coverage!

"Atkins Meets Anorexia"

Atkins meets Anorexia was the lead in title used today on The Morning Show with Mike and Juliet.

Anyway, the show!

Here's a recap!

Images of Christin at her home, telling her story.

(She's so beautiful! We love you Christin!) She talks about the images of "Kimmer" on the homepage and her desire to lose weight. The story follows Christin's journey through weight loss to the Woman's World magazine cover and then her health issues that arose. Christin outlines the dangerous advice that Kimmer gave her, including daily laxative use and the questions she asked Kimmer about the safety of the diet in her role as PR Director and her ultimate termination from her role within Kimkins.

Video from the PI showing Kimmer's current visage are shown as well as the Russian Brides website photo theft.

On stage is Deni, (also beautiful! we love you Deni!) Christin, Jeannie and Melanie (SingingLass).

Christin compares Kimkins to anorexia and talks about her medical issues as a result of the diet. Mike brings up "SNATT" and Juliet says that Christin's symptoms sound just like the problems anorexics face.

M and J turn to Jeannie next and ask for a response. Jeannie says that Kimmer is in fact Heidi Diaz. Jeannie then says that there is a full explanation is already on the website, but it was NOT at the time the show aired. It is now, though.

Jeannie admits that Kimmer used poor marketing tactics, but the diet still works! It changes lives! She then goes after Christin and says to Christin that "You were under medical supervision!" and Christin says that she was not. They talk about laxatives and Jeannie says that they only recommend a laxative if someone has "potty problems" and Deni says "that's not what it was when I was on the plan" and Jeannie comes back with "Well, we're always open to making positive changes".

Jeannie has the audacity to tell Christin and Deni that THEY set a bad example for everyone and it was there fault as moderators for not helping others be safe. (BAD JEANNIE!)

Jeannie then says on national TV that Kimmer couldn't be there because of litigation and her deposition today and that Kimkins is currently dealing with a lawsuit. lol.

Deni then tells her story and her and Christin discuss how addictive the Kimkins plan was. Juliet says that it sounds as though they developed an eating disorder and Christin agrees.

Jeannie says that she is at Kimkins to make positive changes, to make every wrong right, as per her promise to the low carb community. She then says that they have a bariatric surgeon who is considering joining the Kimkins team. (Wuh oh.. lol)

Singing Lass is talking about her weight and blames it on steroids. Says that she lost 102 pounds and she stalled on Atkins. Says she was worried about side effects from WLS but the side effects from Kimkins are ok.. lol. Silly girlie! She doesn't look like she's lost 102 pounds........

Jeannie says that she feels like she's in the middle of a terrorist attack..... omg.

Next up.. the dietician and the doctor have a go at the Kimkins plan!

Reg. Dietician Glassman and Dr. Seigel (sp?)

Tippy accidentally sent an email that says "there will be a nutritonalist there as well, that scares me...." to the producer of the show! lol Glassman corrects her and says its "nutritionist", LOL.

The dietician rips right into Jeannie and yells at her for picking on Christin. Says that Heidi has as much right to give diet advice as she does to give legal advice. Says its completely unethical.

Dr. Seigel says the diet is ATROCIOUS. (He also discusses ketosis as a dangerous state for anyone with medical problems). He talks about the egg white challenge on the Kimkins site.

Dietician says the diet is dangerous because of lack of fiber and calcium and very low calories.

Dr. Seigel says that "No self respecting doctor would be
associated with this plan". "It's a total disaster and you could end up in the hospital".

Excellent show! Brava to Christin and Deni! And a special thank you to CJ, Mike and Juliet for bringing much needed national attention to this horrible, dangerous fraud!

Dear Kimkins Members,

OK, so it's time to come clean. (a bit late for that, we all know the truth already!)

In view of recent events (can you say lawsuit?) and the feedback I've received from members, I've decided to set a few things straight. (A few things.. lol) Those of you who know me are well aware I'm a private person and prefer to remain that way. However, that doesn't seem to be in the cards.

So, let's put a few burning questions to rest:

Q: Who is Kimmer?

A: Heidi Diaz (translated - "I LIED when I said Kimmer and Heidi were 2 different people, many times!")

Q: Why the drama, denial and hiding?

A: For the past 10 years it was to avoid an invasion of my own privacy. However, for the past 3 years it was to protect the identity of my foster children. California foster regulations prohibit foster parents from making statements that would identify children as "foster", even by association. (IF you have any foster children, you broke the law by even mentioning them!) Identifying myself which could lead to my home address or identifying me in public could identify them. (PI didn't see any Foster Children while he was staking out your apartment.)

Q: Did you lose 198 pounds in 11 months?

A: No. But I did lose 100 pounds in 6 months. (cough BS cough) However, since Kimkins appeared on the Woman's World cover, I've been glued to my computer. I'm no different than any of you (YES you are. Not everyone is a pathological liar and a sociopath!) and I'm well familiar with stress eating or grabbing what's handy instead of what's Kimkins friendly. (And you're good at blaming others for doing it, too!)

Q: So you've regained the weight?

A: Yes, but I've been back on Kimkins for 2 weeks and have lost 23 pounds so far. (cough BS cough) I gain fast and I lose fast, that's how it's always been. I'll be experimenting and rotating with each option except Cycling because that will be too much temptation for me. I'm a lifelong dieter and I know what a free week (or weekend) will do to my willpower. (What willpower, sugar cookie?)

Q: What about the model photos in some of the Success Stories?

A: The majority of our earliest Success Stories were from another website and we couldn't take those with us. We wanted to show visitors the possibilities with Kimkins. So, while we built up (invented, stole, falsified) our newest batch, I created stories (I made stuff up and lied) which were a compilation of previous successes that people had shared with me over the past 10 years. We're extremely proud of all of our members (paid and unpaid) who have experienced weight loss success.
(Again, Kimmer with the half-truths. Just say "I stole some pictures from a Russian Bride website and pretended they were real success stories to try to convince people to join!")

Q: You have been photographed without hair. Did Kimkins do that?

A: Absolutely not. (But it DOES cause hair loss! Way to try to spin it!) I developed alopecia universalis 23 years ago. (Aww poor you. Not.) It is an autoimmune disease that causes total body hair loss. Our family has cluster autoimmune conditions. Mine are alopecia, hypothyroidism and eczema. Other family members also include alopecia plus type 1 diabetes type 1, multiple sclerosis, lupus, eczema and rheumatoid arthritis. Autoimmune is when your body attacks itself and destroys certain functions. Most people with an autoimmune condition develop more than one. If one person in a family develops an autoimmune condition, other family members tend to develop them. (Bla bla bla, whatever. You LIED about your wonderful hair care routine. Just say that. Enough of the pity party.)

Q: What about the people who joined Kimkins because you said you lost 198 pounds in 11 months or because of the success story re-enactments?

A: I offer my sincere apology (Too late! You banned most of them! Cow.) to anyone (which is everyone) who felt misled or joined purely on that basis. That was never our intent. (The hell it wasn't! In fact, I'm going to be part of the "Watch Us Lose" models on the homepage (UGH spare me) and will update my stats each week, add updated photos and post in the Kimmer's Back on Track Challenge. I will lose my weight all over again and everyone is welcome to lose right alongside me. I had baseline medical tests done a few weeks ago and will share both my starting and final results once I reach goal which I hope to be around my birthday in May 2008.

Q: Will we ever meet "Kimmer"?

A: I'm going to do my best. (which means I'll have some family crisis and won't be there) I truly am a shy person (oh please) who prefers to stay in the background, but a Kimkins Cruise is planned for Summer 2008 and I'll be there to meet & greet everyone! We will be asking members for feedback on local meet-ups as well so everyone has a chance to meet me and network with other Kimkinites! (Hey! Thats OUR word! Thief!) Support is everything in successful long term weight loss. (How would you know... exactly?)

Q: Anything else? REAMS!

A: Kimkins works. (Duh. Anyone that doesn't eat will lose weight. Doesn't mean its safe!) I have offered my internet style of Kimkins diet advice for 10 years. (But you're not QUALIFIED or licensed to give diet advice!!) It was hugely successful (because it was based on LIES) which is why Kimkins became popular. My first 8 years were 100% voluntary and I even turned down gifts. (except the ones I scammed people out of by saying I lost my purse, etc.) My goal has always been for people to learn the very simple and very effective basics of quick weight loss. This remains our focus today. Anyone who wants a refund and cancellation, please let us know.
Everyone who wants to stick with Kimkins -- well, what are you waiting for? Let's do it! I've got, uh ... a couple of pounds to lose myself and I could use some support!

* The mysterious "new owners"
* The lawsuit
* The foster children fundraiser scam
* The founder of the plan weighing 300+ pounds
* The Acupuncturist giving medical advice not pertaining to his field
* Fitness Guru who mysteriously disappeared after saying no one should go below 1200 calories?

On and on and on.. There is no defense for any of those things. Her entire platform will be "but the diet works! People are losing weight!" Sure it does, Tippy. Anyone that doesn't eat will lose weight. Duh.

Heidi Diaz - You Have Been Served!

It's official!

Heidi Diaz (and Brandon Diaz) have been served! Heidi is due to appear before the court on November 1st and Brandon is due to appear on November 2nd.

Now we wait and see if she actually shows up or thinks she can just ignore it and it will go away - as was her theory about ignoring all the "haters" and "Negative Nancies". Heh.

Fitness Guru Gone!

After wondering why Fitness Guru hadn't been posting after his last comment that no diet should ever go lower than 1200 calories, which is completely NOT Kimkins... we did a bit of research with some help.

Sure, the bizarro mystery of Fitness Guru pales in comparison to the exponentially bizzaro-er mystery of Heidi herself.

But while we're waiting for the feds to shut down the Kimpire and waiting for the courts to shut down Heidi, these submysteries do serve to further emphasize the really astounding extent to which Heidi's scam has affected so many lives -- from a singing Mormon psychic in Oregon, to a quack acupuncturist in Florida, to thousands of desperately dieting women across America, to young men in Malaysia hired to pretend to be hyperactive overachieving Kimkinoids, to Russian mail order brides!

The world of The Kimmer is a wild, wild world indeed!

Anonymous, it's not slander if it's TRUE. If you re-read the post, we checked with the Florida State Department of Health on his current licensing! HE IS NOT a Primary Care Physician! He is an acupuncturist! That does NOT give him the required medical background to be giving out diet advice! Hello? What exactly do you not get about that?

Kimkins Class Action Lawsuit Filed!

As revealed by KTLA news last night, the class-action lawsuit against Heidi Diaz / Kimmer / Kimkins has been filed! Heidi Diaz is due to appear in court on November 1st to give her sworn deposition in answer to the complaint filed by the plaintiffs.

We've read the entire complaint and it is very long and very thorough - including information about the Russian Brides photos as discovered by the gals at LCF, the baseless medical claims made by "Kimmer" and other instances of fraud.

So, who's up for a road trip? :D

The Rise and Fall of the Kimkins Diet

The website, CalorieLab has posted it's review of the Kimkins plan. Below is an excerpt of the article:

The Web site for the Kimkins Diet boasts that there is “no faster diet” and that people lose weight without exercise, special foods, diet pills or supplements.

The site describes the diet as a low carb, low calorie plan that allows users to lose up to 5 percent of their body weight in 10 days. The diet came to national attention after being featured on the cover of Woman’s World magazine in June, with a story that called the diet “better than gastric bypass” and told of the success of a woman who had lost 100 pounds in five months.

The trouble is, the whole diet plan was a scam.

Reporter Michelle Kay, at Bay News 9 in Tampa, Florida, is interested in doing an expose' of the fundraising scam.

Note: "interested in" ... not "committed to" ... 'cause she needs some PROOF before she can commit to doing the story.

She's looking for:

1. victims of the scam (meaning, people who were kind-hearted enough to actually donate money) who are willing to be interviewed on camera

2. screen shots (not copy/pastes) of actual posts, pm's, and/or emails written by Jeannie S. Baitinger a.k.a. "Tippy Toes" which prove that:
a) Jeannie was in charge of the "Kimmer's Kids" fundraiser
b) Jeannie is still in charge of fundraising activities ("for charity") at

We were trying our best to keep this quiet and word behind the scenes, but a week now has passed and so far no one has come forward. Perhaps too much time has passed already, and if so, there's no sense in trying to interest the media in this aspect of the whole Kimmer/Kimkins thing.

When speaking of this matter, everyone please remember to stick to the facts only, those being:

The California State Ombundsman's Office says there weren't any foster children at the time of the fundraisers -- and the Community Care Licensing office (Virna Wright, contact person) says it's illegal for anyone to take donations for foster children, real OR fake, by actively raising those funds and/or accepting those funds. Jeannie S. Baitinger of Zephyrhills Florida ("TippyToes" or "Tippy") spearheaded the Kimmer's Kids fundraisers, and the money was sent to Heidi K. Diaz of Corona California ("Kimmer"). These are the facts. They are not allegations and they are not libel.

We hope for an official investigation into this matter, and if crimes have been committed, we hope for justice to be done.

Kimkins Disaster on Myspace

Another Kimkins blog was found on myspace by an LCF poster. We wanted to include it here!

Heidi’s world has since come crashing down on. In the past several weeks alone, there has been a coup of sorts, amidst accusations of her diet making people sick. (A former member of the Kimkins team who was featured in Woman’s World magazine tells of her experience).

That’s just the beginning. As the story begins to unravel, sources have also determined that “Kimmer” had lied about losing the extraordinary amount of weight (see recent photo here), had taken up a collection for foster children she did not have and posted phony success stories (in addition to her own).

OK. Dr. Mark has listed his credentuals in the health and wellness threads. He has been brought in as a staff member to help answer questions in his field for members. We feel his presence is quite valuable to the website and we are thrilled to have him here. However, Dr. Mark should not be used as a substitute for your own Physician.

I do not know details of the transaction. As far as the new owners they have chosen not to announce themselves as of yet. We have been told the site would operate as normal and there are no indications we will close. Nothing more, nothing less.

The only changes being made to the site are positive additions (such as Dr. Mark and the fitness guru) so there is really nothing more to announce at this time.

This member and another who agreed with this member about needing more info were told they have new PMs. Neither heard from since.

The only field that "Dr." Mark is qualified to answer questions in, is acupuncture. To the best of our knowledge, none of the Kimkins plans require acupuncture services.

The doctor may be seriously reconsidering his involvement. He denied being on staff, and then HE asked a question - because there were so many people already offering good advice, ARE THEY SURE THEY EVEN NEEDED HIM? He was warned, but likely never expected the intense scrutiny he has received. Now maybe he's withdrawing.

Kimkins Dr. Mark on Gallbladders

"Dr." Mark posted an answer to a question about gallbladders which has us scratching our heads. He apparently does not know what the gallbladder is or how it works, yet attempts to issue a statement as if he is an expert, or even, *gasp*, a doctor.

The truth about the GB.

The GB is mearly a storage sac for bile. I has a small duct that opens to the first part of the intestines after the stomach.

Bile is a substance produced by the Liver that emulisifies fat. (dawn dish washing liquid takes grease out of your way)

FAT TY foods leave the stomach and it gets the message to send out a squirt...bigger the fat...bigger the squirt.

Emulisification breaks up the fat into very small particals which the small intestine can easily digest.

When the gall bladder is removed, the "in tube" is connected to the "out tube" and now you have a slow drip of bile constantly as produced.


After this surgery you will never _meta_bolize large quantities of fat well. You have to change your diet or indigestion and loose stool will follow every high fat meal. Your GB can no longer "squirt" for those larger quantities.

GBs don't get screwed up from too litte use, rather too much. Glands - all glands for the most part, like to hang out full until called upon (they are quite lazy) and when worked, they just like to work for a little while, then fill back up and go to sleep.

Lower fat diet (that fits here) and digestive enzymes with fatty foods will help.

and No, "Dr" Mark they are NOT interchangeable terms!


(Science: anatomy) a digestive organ which stores bile (produced in the liver), used in the digestion and absorption of fats in the duodenum. a muscular sac attached to the liver that secretes bile and stores it until needed for digestion.


A butterfly-shaped endocrine gland in the neck that is found on both sides of the trachea (windpipe). It secretes the hormone thyroxine which controls the rate of metabolism.

Much worse than making false claims about ones weight loss, giving inaccurate medical advice can kill people (faster). This madness must end.

You know this is very scarey. I have had my gallbladder removed and I have no trouble eating fatty foods.

I love his "scientific" descriptions on things. It's unbelievably inaccurate and very scarey.

He should have a warning label on all his advice. Don't take it!!!

Since my gall bladder surgery, I seem to have an intolerance for dairy. I have horrible painful gas followed by diarrhea-type waste immediately after nearly every meal. I've minimized my dairy to see if that helps. It really has, now I only need to establish how much dairy is acceptable for me. I had already tried not eating fatty foods, which didn't work. Now, it seems, I can eat fatty foods but no dairy. What he's describing is LACTOSE intolerance. Sure, I stay away from the really greasy stuff now, that stuff gave me gas any way.

"Dr." Mark at Kimkins, also known as Mark Brinson refers to himself as a Primary Care Physician. The licensure department for the Florida Department of Health responded to an inquiry of Mark Brinson's use of the term "Primary Care Physician" as follows below:

Please be advised that the phrase "Primary Care Physician" is not located in the Florida Laws and Rules that govern Acupuncture scope of practice. However, the below language does outline the language "primary health care provider".
457.102 Definitions.--As used in this chapter:

(2) "Acupuncturist" means any person licensed as provided in this chapter to practice acupuncture as a primary health care provider.

We strongly urge all Kimkins members to carefully research any "medical advice" given by "Dr." Mark for two reasons.

First, questions surrounding his claims of licensing have shown that he has used exaggerated claims, both within Kimkins and on his own websites, of his license status and title.

Second, please do not ever take medical advice from a person who admittedly eschews medical books and does not know the difference between an organ and a gland. YOUR health could be at risk, this is not a game of Russian Roulette (no pun intended).

Whatever advice he gives is worth what you paid. You didn't? Then it's worthless. Please don't diagnose yourself and follow advice from someone who doesn't know you and can't do proper research.

"Love To Know" Reviews Kimkins

The Love To Know website has reviewed the Kimkins diet plan - take a look at THIS ARTICLE. Below is an excerpt.

Brief History of the Kimkins Plan

"Kimkins" is named after "Kimmer", the user name of a weight loss forum visitor. Kimmer shared her weight loss experience in the forum, chronicling her successes and her failures. When she reported a drastic weight loss-- 160 pounds in seven months-- she developed almost a cult following. Fellow forum posters wanted to know how she did it, so Kimmer painstakingly answered questions and offered advice, and others lost dramatically, too! Soon Kimmer took her weight loss plan to the masses, creating a website and appearing in Woman's World magazine.

Who Is Kimmer?

The exact identity of Kimmer remains a mystery. Woman's World magazine identified her as Kim Drake, but websites have named her as Heidi Diaz. Kimmer herself has never offered her name, neither on the message boards or her own website, but she has given some information about her identity:

  • She is a lifetime dieter, learning by research and trial-and-error rather than medical school
  • She is a former welfare mom
  • She is a California housewife

New developments: it has recently been proven by a private investigator that Kimmer is Heidi Diaz and that she is still overweight. Further, the pictures used on her site as testimonials have been found on Russian mail-order sites. The before and afters are fake.

At the end of the podcast, the audio of a phone call, made by Jimmy to Heidi's phone number (the same one used during the previous "Kimmer" interviews), reveals the same voice heard on the first interview as well as the KTLA news segment where Heidi comments "I have no comment" before jumping into her car.

Anyone still involved with Kimkins needs to listen to this episode, especially those putting their reputations, licenses and professional careers on the line to make a quick buck from the scam website.

Trying to bolster his own business from the Kimkins members on top of promoting (aiding and abetting?) the Kimkins fraud. Not good. We hope that Nick is simply not aware of the fraud and agreed to work for Kimkins without knowingly ignoring the facts of the matter. It is hard to believe that any professional in any field would sign on to an internet scam business simply to earn a few bucks, but........

We shall see.

He has a bachelor's and about as much certification and stuff as I've seen with personal trainers at LA Fitness and Gold's Gym. So, can't diss him there.

I do think he's just an ambitious guy who saw an opportunity with the Kimkins thing. I'll give him the benefit of the doubt unless he shows his hand. He probably is eager to sell a lot of fitness stuff. :D

Too bad he didn't have the sense to google up Kimkins.
